Abu Sa’id al-Khudri reported: The Messenger of Allah, peace and blessings be upon him, said, “Beware of loitering in the roads.” They said, “O Messenger of Allah, we have nowhere else to sit and talk.” The Prophet said, “If you insist, then give the road its rights.” They said, “What are its rights, O Messenger of Allah?” The Prophet said, “Lower the gaze, refrain from harm, return greetings of peace, enjoin good and forbid evil.”

Imam Ibn Muflih commented, “It is discouraged to gather in public roads for discussion and so on due to what it involves in presenting temptations and harm to others… As for the wide public road, then chivalry and honorable conduct require avoiding sitting in it. But if one does sit there, he must fulfill the rights of the road: lowering the gaze, guiding the lost traveler, returning greetings of peace, collecting lost property so it may be announced to its owner, enjoining what is right, and forbidding what is wrong. Whoever sits therein without giving the roadway its rights has exposed himself to unjustly harming people.”

عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ رَضِيَ اللَّهُ عَنْهُ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ إِيَّاكُمْ وَالْجُلُوسَ عَلَى الطُّرُقَاتِ فَقَالُوا مَا لَنَا بُدٌّ إِنَّمَا هِيَ مَجَالِسُنَا نَتَحَدَّثُ فِيهَا قَالَ فَإِذَا أَبَيْتُمْ إِلَّا الْمَجَالِسَ فَأَعْطُوا الطَّرِيقَ حَقَّهَا قَالُوا وَمَا حَقُّ الطَّرِيقِ قَالَ غَضُّ الْبَصَرِ وَكَفُّ الْأَذَى وَرَدُّ السَّلَامِ وَأَمْرٌ بِالْمَعْرُوفِ وَنَهْيٌ عَنْ الْمُنْكَرِ

قال ابن مفلح وَيُكْرَهُ الْجُلُوسُ عَلَى الطُّرُقَاتِ لِلْحَدِيثِ وَنَحْوِهِ لِمَا فِيهِ مِنْ التَّعَرُّضِ لِلْفِتَنِ وَالْأَذَى … أَمَّا الطَّرِيقُ الْوَاسِعُ فَالْمُرُوءَةُ وَالنَّزَاهَةُ اجْتِنَابُ الْجُلُوسِ فِيهِ فَإِنْ جَلَسَ كَانَ عَلَيْهِ أَنْ يُؤَدِّيَ حَقَّ الطَّرِيقَ غَضُّ الْبَصَرِ وَإِرْشَادُ الضَّالِّ وَرَدُّ السَّلَامِ وَجَمْعُ اللُّقَطَةِ لِلتَّعْرِيفِ وَالْأَمْرُ بِالْمَعْرُوفِ وَالنَّهْيُ عَنْ الْمُنْكَرِ وَمَنْ جَلَسَ وَلَمْ يُعْطِ الطَّرِيقَ حَقَّهَا فَقَدْ اسْتَهْدَفَ لِأَذِيَّةِ النَّاسِ
