Hadith on Rights: If a husband fails to fulfill his family’s rights

Aisha reported: Hind bint ‘Utba came and she said, “O Messenger of Allah, Abu Sufyan is a stingy man. Is there any blame on me for using his wealth to feed our dependents?” The Prophet, peace and blessings be upon him, said, “There is no blame if you feed them with a reasonable amount.”

Al-Nawawi said, “Whoever has a right upon another and is unable to procure it, it is permissible for him to take it out of his wealth, by the measure of his right, without his permission. This is the way of our scholars. That was prohibited by Malik and Abu Hanifa, may Allah be pleased with them.”
